Employment requirement
Section: 7-10
(a)
The grantee shall be required to establish an equal opportunity program which will ensure equal opportunity for employment of females and minorities in all phases of its operation. This program shall include, but not be limited to, the construction and operation phases of the grantee's operations.
(b)
The grantee shall make its best efforts to allow maximum feasible participation by minority business enterprises in all aspects of the construction of the cable television system within the city. The utilization of minority business enterprise contractors shall reflect and be equal to the availability of such contractors within the grantee's franchise area.
(c)
All contractors and subcontractors of the grantee shall make their best efforts to assure maximum participation by females and minorities in all phases of their operations, and to have a written policy which describes the methods to be used to accomplish this requirement.
(d)
The grantee shall establish an affirmative action program which provides for the successful employment of females and minorities in the construction phase and all employment categories of the grantee's cable television operation. The affirmative action program shall include, but not be limited to, the following: recruitment advertising, employment interviews, employment, rates of pay, upgrading, transfer, demotion, layoff and termination.
(e)
The grantee shall, in an effort to assure proper utilization of all segments of the local work force, initiate a program to provide training classes and on-the-job training experience in all phases of its operation, including managerial, skilled and clerical positions. These programs shall be made available to women and minorities to the maximum extent that it is feasible.
(f)
The review and monitoring of the provisions of this section shall be undertaken by the equal employment office division of the city so as to ensure total compliance within a reasonable period of time, not to exceed three (3) years.
(g)
The grantee shall strictly adhere to the equal employment opportunity regulations of the Federal Communications Commission and to all federal, state and local laws and executive orders pertaining to discrimination, equal employment opportunity, and affirmative action.
(h)
If any of the provisions of this section are in conflict with the equal employment opportunity regulations of the Federal Communications Commission, the provision which places the greatest responsibility upon the grantee to provide opportunities for women and minorities shall prevail.
