Operational requirements and records

The grantee shall construct, operate and maintain the cable television system in full compliance with the rules and regulations, including applicable amendments, of the Federal Communications Commission and all other applicable federal, state or local laws and regulations, including the latest editions of the National Electrical Safety Code and the National Fire Protection Association National Electrical Code. The director of telecommunication and cable communication or his designated inspectors shall have the authority to formulate, assess and enforce the regulations and requirements of this chapter. All parts of telecommunication and cable communication systems in the city shall be subject to inspection by the director of telecommunication and cable communication or his designated inspectors to ensure compliance with all applicable federal, state and municipal rules and regulations. The city hereby reserves the right to review a grantee's construction plans prior to the commencement of construction to ensure compliance with all applicable federal, state and municipal rules and regulations. In order to facilitate the inspection of the grantee's distribution system by city cable inspectors, the grantee shall provide all necessary indemnity and insurance coverage that may be required by the owners or lessees of the utility poles upon which the distribution system may be attached, and the grantee shall name the city as coinsured on such policies of insurance.
