Penalties

(a)

Notwithstanding any other remedies provided for in this chapter or otherwise available under law, the city shall have the power to impose the following monetary penalties if the grantee violates any provision of this chapter, the franchise, or any rule or regulation lawfully adopted thereunder:

(1)

For failure to submit plans indicating expected dates of installation of various parts of the system: up to five hundred dollars ($500.00) per day;

(2)

For failure to commence operations in accordance with herein stated provisions: up to five hundred dollars ($500.00) per day;

(3)

For failure to complete construction and installation of system within proper time: up to five hundred dollars ($500.00) per day;

(4)

For failure to supply data requested by the city in connection with installation, construction, customers, finances or financial reports, or rate review: up to five hundred dollars ($500.00) per day;

(5)

For failure to comply with reasonable recommendations of the city relating to rates or services and/or interconnection and such other reasonable requests or recommendations as may be made pursuant to authority granted by this chapter or the franchise, or to respond to subscriber complaints within the proper time: up to one hundred dollars ($100.00) per day, as the city may determine.

(b)

The following acts shall be deemed offenses under this chapter: willful action or inaction by grantee as described in section 7-61(a); arbitrary or capricious action by a grantee as described in section 7-62; willful failure by a grantee to comply with the laws, rules, or regulations described in section 7-109; and transmission by a grantee of a signal from a subscriber's premises in violation of section 7-115. Persons, whether natural or artificial, or commercial entities who commit the offenses described herein shall be subject to a fine not to exceed five hundred dollars ($500.00) for each offense; each day of the violations shall constitute a separate offense.
