Procedural powers of the CEB and special magistrates

(a)
The CEB and CESMs shall have the power to:
(1)
Adopt rules of procedure for the conduct of its hearings which are consistent with the City Code or F.S. Ch. 162;
(2)
Subpoena violators and witnesses to its hearings. Subpoenas may be served by the sheriffs office or duly qualified private process server at the expense of the requestor. Issuance and returns of service for CEB or CESM subpoena shall be governed by the rules enacted by the CEB or CESM, respectively, to conduct its hearings;
(3)
Subpoena evidence to its hearings;
(4)
Take testimony under oath;
(5)
Issue an order having the force of law commanding whatever steps are necessary to bring the violation in compliance. However, no order can direct action be taken that violates any provision of the City Code.
(b)
The CEB and CESMs shall not have the power to award attorneys' fees or costs.
