Special settlements for liens imposed by code enforcement board/special magistrates

The city attorney's office is authorized to settle liens imposed by the code enforcement board or code enforcement special magistrates to a two hundred fifty dollar ($250.00) administration fee for each lien on properties when the property with the violations is used as a community garden as long as the following conditions are met:

(a)

All active violations on the property must be corrected;

(b)

The property must meet the community garden requirements found in Chapter 27 of this Code;

(c)

The property owner and any lessee of the property must execute the city's community garden agreement that will be submitted to the city attorney's office and the neighborhood enhancement department. A lease between the property owner and lessee shall be attached to the agreement;

(d)

The group managing and maintaining the land muse be (1) an Officially Registered Neighborhood Association with the City of Tampa Neighborhood and Community Relations office or (2) an incorporated not for profit entity as evidenced by a valid certificate of status issued by the Department of State;

(e)

The property must be used as a community garden for the minimum of one year; and

(f)

The use of the property as a community garden must be verified by the neighborhood enhancement department.
