Who Needs a License

Under Florida law, a person who sells, purchases, exchanges, rents, or leases real property on behalf of another for compensation must hold a real estate license. [Fla. Stat. § 489.105] defines a "real estate broker" as any person who, for another and for a fee, commission, or other valuable consideration, sells or offers to sell, purchases or offers to purchase, or negotiates the purchase, sale, or exchange of real estate or a business opportunity.

Similarly, a "real estate salesperson" is defined as any natural person who is employed by a licensed broker and who does any of the acts described above on behalf of the broker.

How to Get Licensed

  1. Meet eligibility requirements: You must be at least 18 years old and a Florida resident (or maintain a place of business in Florida).

  2. Complete pre-licensing education: Take an approved real estate sales associate or broker pre-licensing course from a Florida-authorized provider.

  3. Pass the state exam: The Florida Department of Business and Professional Regulation (DBPR) administers the licensing exam. You must score 75% or higher.

  4. Apply through DBPR: Submit your application, exam results, and fees to the Florida Department of Business and Professional Regulation.

  5. Get broker sponsorship: Before licensure becomes active, you must be employed by or associated with a licensed Florida broker who sponsors your license.
