Who Needs a License

Under Florida law, a real estate broker or sales associate must hold a valid license to sell, buy, exchange, rent, or lease real property on behalf of another person for compensation. [Fla. Stat. § 489.105] defines a "real estate broker" as any person who, for another and for a fee, commission, or other valuable consideration, sells or offers to sell real estate or leases or offers to lease real estate. A "sales associate" is any person employed by or associated with a broker who performs real estate services.

Unlicensed activity in real estate transactions is prohibited and constitutes a violation of Florida law.

How to Get Licensed

Real estate licensing in Florida is administered by the Florida Department of Business and Professional Regulation (DBPR), Division of Real Estate.

Broker License Requirements:
- Pass the Florida real estate broker exam
- Complete required prelicensing education (typically 72 classroom hours)
- Demonstrate two years of active experience as a licensed sales associate within the five years preceding application, or equivalent experience acceptable to the division
- Submit application and fees to DBPR

Sales Associate License Requirements:
- Pass the Florida real estate sales associate exam
- Complete required prelicensing education (typically 63 classroom hours)
- Submit application and fees to DBPR
- Work under a broker (cannot operate independently)
