Who Needs a License

Under Florida law, a real estate broker or sales associate must be licensed to sell, purchase, exchange, rent, or lease any interest in real property on behalf of others for compensation. [Fla. Stat. § 489.105(1)(a)] defines a "broker" as any natural person, partnership, or corporation that engages in the business of selling, buying, exchanging, leasing, or renting real property, or offering to do so.

A "sales associate" is defined as any natural person employed by or associated with a broker who performs services requiring a license, including listing property, showing property, or negotiating terms. [Fla. Stat. § 489.105(1)(b)]

If you are compensated (directly or indirectly) for these activities, you must hold an active Florida real estate license, regardless of whether you work full-time or part-time.

How to Get Licensed

Real estate licensing in Florida is administered by the Florida Department of Business and Professional Regulation (DBPR) and the Florida Real Estate Commission—not by individual municipalities.

For Sales Associates:
1. Complete a 63-hour real estate pre-licensing course from an approved Florida school
2. Pass the Florida Real Estate Sales Associate exam administered by the Commission
3. Associate with a licensed broker before applying for your license
4. Submit your application to DBPR with proof of broker sponsorship

For Brokers:
1. Hold an active sales associate license for at least 24 months in the 5-year period prior to application
2. Complete a 72-hour broker pre-licensing course
3. Pass the Florida Real Estate Broker exam
4. Submit your application to DBPR

Local Requirements

Hialeah does not issue real estate licenses. All licensing authority rests with the State of Florida through DBPR.

However, if you operate a real estate office or brokerage in Hialeah, you may need a local business tax receipt from the City of Hialeah. Consult the Hialeah Municipal Code for local business licensing and zoning requirements applicable to real estate brokerage operations within city limits.

Exemptions

Attorneys licensed to practice law in Florida who engage in real estate transactions as part of their legal practice are exempt from real estate licensing requirements. [Fla. Stat. § 489.105(1)(a)]
