Subscriber privacy
Section: 11-19
(a)
A licensee shall at all times protect the privacy of all subscribers to the full extent required by section 631 of the Cable Act, 47 U.S.C. § 551, and state law. A licensee shall not condition subscriber or other service on the grant of permission of the subscriber to disclose information which, pursuant to federal or state law, cannot be disclosed without the explicit consent of the subscriber. No penalties or extra charges may be invoked by the licensee for a failure of the subscriber to grant consent.
(b)
Unless otherwise permitted by federal or state law, neither the licensee nor its agents or employees shall, without the prior and specific written authorization of the subscriber involved, sell, or otherwise make available for commercial purposes the names, addresses or telephone numbers of any subscriber or subscribers, or any information which identifies the individual viewing habits of any subscriber or subscribers.
