Reservation of rights

Section: 11-34

(a)

The city reserves the right to amend this chapter as it shall find necessary in the lawful exercise of its police powers.

(b)

Any additional regulations adopted by the city shall be incorporated into this chapter and complied with by all licenses within 30 calendar days of the date of adoption of such additional regulations unless imposition of such regulations would be otherwise prohibited by applicable law or the regulation provides for a longer time to comply.

(c)

The city reserves the right to exercise the power of eminent domain to acquire the property of the cable system of the licensee, consistent with applicable federal and state law. Notwithstanding anything to the contrary, this section shall not enlarge or restrict the exercise of eminent domain of the city except to the extent provided by applicable law.

(d)

The city shall at all times have the right, upon reasonable notice and during normal business hours, to examine records and to inspect the facilities of the licensee to the extent needed to monitor the compliance of the licensee with and performance under this chapter and the license agreement.
