Civil remedies

Section: 17-42

In addition to any other remedies provided by law and by this article, the enforcement agency shall have the following judicial remedies available for violations of this article or any permit condition promulgated under this article:

(1)

The enforcement agency may institute a civil action in a court of competent jurisdiction to establish liability and recover liquidated damages for each violation in an amount of not more than $5,000.00 per offense. Each tree unlawfully removed under the provisions of this article shall constitute a separate offense hereunder.

(2)

The enforcement agency may institute a civil action in a court relief to enforce compliance with this article to enjoin any violation hereof and to seek injunctive relief to prevent irreparable injury to the trees or properties encompassed by the term of this article.
