Securities for loans and conditional sales agreements from minors
Section: 37-5
(a)
It shall be unlawful for any person to purchase or receive possession for security of a loan or any conditional sales agreement from any minor person under the age of 18 years, any personal property of any nature whatsoever, whether new or used, without first having obtained the written consent of the parents or legal guardian of such minor person. The written consent of the parents or legal guardians to such a sale shall contain the name of the minor child offering the property for sale, the name and address of the parents or legal guardians, the business or occupation of the father, if signing, otherwise the business or occupation of the mother, if any, the names of two other persons as references and a description of the property to be sold, including identifying numbers thereof, if any, otherwise a description of property in detail sufficient to readily identify the same.
(b)
It shall be the duty of any person so purchasing or receiving possession for security of a loan or any conditional sales agreement, any personal property from a minor, as described herein, to preserve and keep on file, open to inspection of the circuit court or any officer thereof, of the county, the written instrument signed by the parents or legal guardian of the minor person, giving consent to the sale of the property.
