Alcoholic beverages
Section: 53-87
(a)
Prohibited generally. Except as provided herein, it shall be unlawful for any person to bring alcoholic beverages into the stadium or to possess or to drink alcoholic beverages, as defined in F.S. § 561.01 et seq., inside the stadium.
(b)
When sale authorized. Beer and/or malt beverages may be sold in the stadium by the city, provided that such beverages are not dispensed to the consumer in cans or bottles. The city manager may authorize the sale of said beverages in the stadium by licensed vendors. The aforesaid sale shall not be authorized:
(1)
Before, during, or after any high school event, including, but not limited to, football, soccer, or any high school event held at the stadium;
(2)
Before, during, or after any musical event of the type which historically requires extraordinary security measures, commonly referred to as "rock concerts," based upon prudent police protection.
The aforesaid sale by the city or by authorized vendors is subject to and conditioned upon such terms and conditions as are specified by the city manager. Such specification shall implement policy imposed by the city commission concerning such sale or authorization thereof.
(c)
Designation of areas for serving, dispensing. Alcoholic beverages may be served or dispensed in those areas of the stadium specifically designated by the city manager, subject to and conditioned upon such terms and conditions as are specified by the city manager. Such specification shall implement policy imposed by the city commission concerning such serving or dispensing.
(d)
Effect on existing concession agreements. There shall be no change in existing agreements between the city and the stadium concessionaires as a result of the passage of Ordinance No. 8735.

Case Law reference— Where concession agreement existing at time of passage of Ordinance No. 8735 granted exclusive right to concessionaire to sell beverages at the stadium, and where said ordinance provides an exception to the prohibition against sale of beer and/or malt beverages, authorizing the city to permit sale of same by licensed vendors, concessionaire has the right to sell whatever beverages are to be sold in the stadium and the city does not have the right to permit sale of beer and/or malt beverages by anyone else.
