Who Needs a License
Florida law regulates real estate professionals through the Department of Business and Professional Regulation (DBPR). A license is required if you perform any act defined in Fla. Stat. § 489.105 as a "real estate transaction," including:
- Selling, buying, exchanging, leasing, or renting real property

- Listing or offering to list real property for sale or lease
- Advertising real property for sale or lease

- Assisting in procuring prospects for the purpose of selling, leasing, or renting real property
- Acting as an agent in any real estate transaction
Per Fla. Stat. § 489.105, this applies to brokers, sales associates, and broker associates. You cannot perform these activities for compensation without proper licensure.
How to Get Licensed
-
Apply through DBPR: Submit your application to the Florida Department of Business and Professional Regulation, Division of Regulation, which oversees real estate licensing statewide.
-
Pass the State Exam: You must pass the Florida Real Estate Commission (FREC) examination. The exam tests knowledge of Florida real estate law, practices, and regulations defined in Chapter 475, F.S.
-
Meet Experience Requirements: Requirements vary by license type (broker, broker associate, or sales associate). Generally, you must demonstrate good moral character and meet education prerequisites.
-
Activate Your License: Once issued by the state, your license is valid statewide, including in South Miami Heights CDP.
Do not rely on municipal licensing for real estate practice—state licensure is exclusive and mandatory.
