Who Needs a License

Under Florida law, a real estate broker or sales associate must be licensed to sell, buy, exchange, rent, or lease real property on behalf of others for compensation. [Fla. Stat. § 489.105] defines a "broker" as any person who, for compensation or promise of compensation, sells or offers to sell, buys or offers to buy, or negotiates the purchase, sale, or exchange of real property, or who leases or offers to lease any real property.

Similarly, a "sales associate" is any person employed by or associated with a broker who performs real estate services on the broker's behalf.

Activities requiring a license include listing properties, showing homes, negotiating contracts, and managing transactions. Personal property sales, as well as certain exempted activities (see below), do not require licensure.

How to Get Licensed

State Licensure (required before local operations):

  1. Complete a 63-hour pre-licensing course from a Florida-approved real estate school.
  2. Pass the Florida Real Estate Commission (FREC) licensing exam.
  3. Apply to the Florida Department of Business and Professional Regulation (DBPR).
  4. For brokers: demonstrate two years of experience as a licensed sales associate within the five years preceding application, or equivalent experience, per [Fla. Stat. § 489.105].
  5. For sales associates: affiliate with an active Florida-licensed broker before the license is issued.

Local Requirements

Cloud Lake is located in Palm Beach County, Florida. Real estate licensees conducting business in Cloud Lake must comply with Cloud Lake Municipal Code.

Licensees should contact the Cloud Lake Building Department to determine whether local business tax receipt or occupancy permits are required for a real estate office operating within town limits.
