Who Needs a License

In Florida, a real estate license is required to engage in real estate brokerage or sales activities. Under Fla. Stat. § 489.105, a "real estate broker" is defined as any person who, for another and for a fee, commission, or other consideration, sells, exchanges, purchases, rents, or leases real property, or who negotiates or offers to negotiate the sale, exchange, purchase, rental, or lease of real property, or who advertises or holds themselves out as engaged in such activities.

A "real estate salesman" is defined as any natural person who, for another and for a fee, commission, or other consideration, performs any of the foregoing acts under the direction of a licensed broker.

If you are employed by a licensed broker and perform these activities on their behalf, you must hold an active salesman license. If you operate independently or employ others to perform these activities, you must hold a broker license.

How to Get Licensed

Real estate licensing in Florida is administered by the Florida Department of Business and Professional Regulation (DBPR), Division of Real Estate.

For a Salesman License:
1. Complete a 63-hour pre-licensing course approved by the Division of Real Estate
2. Pass the Florida Real Estate Salesman Examination
3. Work under a licensed broker
4. Submit your application to DBPR

For a Broker License:
1. Hold an active salesman license for at least 24 months during the preceding 5 years, OR hold certain equivalent professional credentials
2. Complete a 72-hour broker pre-licensing course
3. Pass the Florida Real Estate Broker Examination
4. Submit your application to DBPR with broker trust account documentation
