Real Estate Licensing in New Smyrna Beach city, Florida

Who Needs a License

Under Florida law, a real estate license is required to act as a broker, sales associate, or property manager in any transaction involving the sale, purchase, exchange, or lease of real property. Fla. Stat. § 489.105 defines a "real estate broker" as any person who, for compensation, sells, purchases, exchanges, or rents, or offers to sell, purchase, exchange, or rent real property, or who leases or rents, or offers to lease or rent, any real property or its improvements for others.

Any individual or entity engaging in these activities in New Smyrna Beach must hold a valid Florida real estate license issued by the Florida Department of Business and Professional Regulation (DBPR).

How to Get Licensed

  1. Meet educational requirements: Complete a Florida real estate pre-license course approved by DBPR. The course covers state and federal real estate law, principles, and practices.

  2. Pass the state exam: After completing pre-license education, pass the Florida Real Estate Commission (FREC) licensing examination administered by DBPR.

  3. Join a brokerage: Individual sales associates must work under a licensed broker. Brokers must meet additional experience and education requirements, including at least one year as a licensed sales associate in the preceding five years.

  4. Apply through DBPR: Submit your application to the Florida Department of Business and Professional Regulation. Your broker will assist with this process.

  5. Background check: DBPR will conduct a background investigation as part of the licensing process.

More details are available through DBPR's Division of Real Estate.
