Real Estate Licensing in Ormond-by-the-Sea CDP, Florida

Who Needs a License

In Florida, a real estate license is required to engage in the business of selling, buying, exchanging, leasing, or renting real property on behalf of others for compensation. [Fla. Stat. § 489.105 defines a "broker" as any person who, for compensation or the promise of compensation, sells, exchanges, purchases, rents, or leases, or offers to sell, exchange, purchase, rent, or lease any real property.] A "sales associate" performs similar activities under a broker's direction. Both roles require state licensure.

If you are acting solely as the property owner (selling only your own property) without representing others for a fee, you may not need a license. However, if you represent clients or collect compensation for real estate transactions, licensure applies.

How to Get Licensed

Florida real estate licenses are issued by the Florida Department of Business and Professional Regulation (DBPR), Division of Real Estate, not by local municipalities.

Steps:
1. Complete the required pre-licensing education through an DBPR-approved Florida real estate school.
2. Pass the Florida Real Estate Commission (FREC) examination.
3. Affiliate with an active Florida broker.
4. Submit your application to DBPR with proof of sponsorship by a broker and fingerprints.
5. Pay state application fees.

Contact DBPR directly for current exam schedules, approved schools, and application procedures. Your broker will guide you through affiliation requirements.

Local Requirements

Ormond-by-the-Sea CDP is located in Volusia County and is governed by the Ormond-by-the-Sea Municipal Code (available at https://library.municode.com/fl/ormond-by-the-sea-cdp-florida).

Review the municipal code for any local real estate broker or sales associate regulations, local advertising requirements, or local business tax requirements that may apply in addition to state licensure. Contact the Ormond-by-the-Sea Building Department to confirm whether local permits, business tax receipts, or sign permits are required for your real estate office or operations within town limits.

Real estate transactions in Volusia County may also be subject to county-level regulations; confirm with Volusia County Building and Development Services.

Exemptions

[Fla. Stat. § 489.105 exempts property owners acting as principals in their own real estate transactions from licensure requirements.] Owners selling, renting, or leasing their own property without representing others do not need a license. However, this exemption does not apply if you collect fees from others or hold yourself out as a real estate professional.
