Unqualified noncitizen electors willfully voting; prohibited defenses; aiding or soliciting noncitizen electors in voting prohibited.

(1)

Any person who is not a qualified elector because he or she is not a citizen of the United States and who willfully votes in any election is guilty of a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084. A person’s ignorance of his or her citizenship status or a person’s bona fide belief of his or her citizenship status cannot be raised as a defense in a prosecution for a violation of this subsection.

(2)

Any person who aids or solicits another to violate subsection (1) with knowledge that such person is not a citizen of the United States is guilty of a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.
